GAVYN DUNN, 20 , pleaded guilty to causing death by reckless driving and was sentenced last Thursday to three years probation in the St Elizabeth Circuit Court. He will not be eligible for holding a driver's licence for two years.
The prosecution led evidence that about 6:40 a.m. on August 27, 2003, Tishan and Harve Senior, both 12, were on their way to a shop in Newton district in St Elizabeth. They were walking along the roadway when the accused man, who was driving a Toyota motorcar, left his side of the road and collided in to them.
They were rushed to the Black River Hospital where Harve succumbed to his injuries.
The court heard that Dunn, 17 at the time, never had a driver's licence.
But the dead child's mother, who was in court, asked the presiding Judge to be lenient with Dunn and not to send him to prison as he was a well-mannered and disciplined child.
She also told the Judge that the two families had been friends for a number of years and their children all played together.
