AN ATTORNEY REPRESENTING three murder accused fiercely argued that one of his three clients was being held in custody despite a witness' failure to point him out in an identification parade and referred to the situation as a "scandal".
Attorney-at-law, Carl Miller, representing Bryan Morris, 26, of Albion Lane, who is charged along with two juveniles, (ages 16 and 15) was outraged at the fact that his client was being held despite not being pointed out at an identification parade and also was annoyed at the fact that the investigating officer's statement could not say where the juveniles were when the actual shooting took place. He called the allegations "fiction".
"It's no fiction that someone has been killed," RM Henry reminded Mr. Miller. She also reminded him that the witness did see the accused with a firearm and saw all three men running after the shooting.
THREAT HEARD
A witness alleges that about 11:15 a.m. on November 30 last year, he was standing on Albion Lane when he saw the two juveniles running from King Street and said he heard one of them uttering a threat that he had to kill someone in Canterbury. The two then went to a house nearby and called someone. The witness said that Morris came out of the house and all three men proceeded to across the bridge on to King Street with Morris holding what appeared to be a firearm.
The witness pointed out the juveniles, who were placed on an identification parade along with Morris. However, Morris, whom the witness said he had known for eight years, was not pointed out. The police, however, outlined that the witnesss gave a full description of Morris and was able to say exactly where he lives. Morris in an interview with the police, confirmed the information the witness had given.
The witness alleges that he saw Morris grab the deceased, Rayon Morgan, whom he knew as Tommy, from the back and fired three rounds. The deceased fell to the ground and the three men fled the scene in the direction of Albion Lane.
RM Henry said she would be in a position to consider the issue of bail after she had reviewed the statements for herself.
The three were remanded in custody and will be brought before the court next Monday, February 13.
