Mom punched, 'father' charged with assault
FOR MORE THAN a year, Gary Smalling contributed money to the maintenance of a child he thought was his.
On June 7, he received the shock of his life when the woman who he thought was his child's mother told him the baby wasn't his. That shock has landed him before the Corporate Area Resident Magistrate's Court on assault charges.
Myers, a janitor from Kingston 12, pleaded guilty to a charge of assault occasioning bodily harm after he punched the complainant in her face after she told him he had 'fathered' a jacket.
BABY NOT HIS
The court was told that on June 7, Smalling went to the complainant's home to look for the child but could find neither the mother nor baby. He reportedly left and went up the road where he saw the complainant. He asked the complainant for the child and was told he should not ask for the baby as it did not belong to him.
"When she tell mi dat Your Honour mi jus get mad an' punch har because she seh di baby a nuh fi mi after mi an' har deh from last year an' mi gi har money fi look after di baby," Smalling told RM Georgiana Frazer.
The complainant, who was present in court, at first refused to admit she took money from Smalling for the child. She admitted however when Clerk of Courts Hansurd Lawson pressed her about the matter. She also admitted the child was not his.
AFFECTED ABILITY TO EAT
The complainant told the court the blow she received had affected her ability to eat.
RM Frazer then ordered a probation report in Smalling's background and told the complainant to return to court with her medical bills. She then set July 31 as the date for Smalling to be sentenced.
