A St Catherine man charged with smoking ganja decided that a DNA result will have to be the way forward, as he was not guilty of the offence.
Ricardo Harvey's attorney, Linton Walters, renewed the application in the Spanish Town Resident Magistrate's Court on Tuesday.
"Your Honour, as I said on March 17, the officer needs to furnish the court with a DNA result, as he claims to have retrieved the cigar from my client's mouth, and my instructions are different."
He added that it was not surprising that the policeman had not submitted the sample for a DNA, due to the report he got from his client.
The reports are that in early March, the accused man was seen by the police. He suddenly pushed the cigar that he was smoking into his mouth. It was taken out and he was charged with smoking ganja. He has maintained his innocence.
RM Marcia Dunbar-Green gave the investigator until September 16 to present the certificate.
