The attorney representing a man accused of having a relationship with a 13-year-old girl asked for the charges to be dismissed, claiming his client was innocent.
André Ashbourne pleaded not guilty to carnal abuse in the Corporate Area Resident Magistrate's Court on Wednesday.
Allegations are that the accused and the teen were in a relationship when she got pregnant.
However, Ashbourne's attorney argued that his client was innocent due to discrepancies in the complainant's statement. He said the complainant claimed she and the accused got involved in December 2007, but the only time both had any sexual relation was in February 2008 and it lasted two minutes.
He said, following this, the complainant was taken to the doctor, on two separate occasions, and she was not pregnant. He said she was taken a third time when it was discovered she was seven months pregnant.
The attorney argued that based on the timeline between the alleged sexual relation and the length of the pregnancy, his client was innocent.
However, Senior Resident Magistrate Glen Brown did not drop the charge, but set another mention date of November 25. Ashbourne was granted $50,000 bail with surety and fingerprinted.
