A woman who has been separated from her husband for the last four years says she is not really interested in divorcing him.
She says she is only interested in getting her 50 per cent share in the house they owned .
"What really bothers me is when I called my brother to represent me in my share of the property, he told me I would have to divorce my husband before I can challenge him for my share in the property," the woman said.
"The truth of the matter is that I am not really interested in filing for a divorce. I am now living in the United States of America and I would like my money from the house to help me to further my studies.
"I have been married for 14 years and I really don't have any money to divorce my husband right now. As a matter of fact I am not really interested in a divorce, but if my husband wants to divorce me I have no problem with that.
"We are joint owners of the property because we bought the lot of land and then shared the costs to build the house. The title states we are joint tenants and I have my documents to prove that I contributed to the building of the house. I would like to know if I would have to divorce my husband before I can get my share in the property."
There is no truth to your brother's statement. A wife or husband does not have to file for a divorce in order to divide a property in which they are joint owners. A property can be divided before or after a divorce so you can now take the necessary steps to have the property divided.
