Divorce settlement |
|||||
A couple who separated last year are having a dispute over a property they bought shortly after they got married in 2002. The wife said she wants her share of the property but her husband, who is living in the house, does not want to sell it. "My husband is telling me that I should leave the house for our two children, but I want to make a clean break from him after we divorce, " the wife said. "If he were a good husband to me I would consider doing that, but my husband cannot be trusted. If I should die tomorrow, I know he could very well turn his back on our two children. He is a real cheat and flirt and I just cannot take the chance of leaving him in charge of my share of the house. "Last month, I got a valuator to go to the property to do a valuation and my husband chased him away. I told him weeks before that the valuator was going to the property, so he had no reason to do that. I just want the property sold or if he wishes to buy my share he can buy it. Right now, all I want to do is to buy a house for me and my children. "I have a ready buyer for the property if my husband is not interested in buying my share. "What can I do if he keeps turning away the valuator?" she queried. You will need the services of a lawyer to handle the sale of the property or to transfer your share to your husband if he decides to buy it. If your husband continues to interfere with the valuator, then you can ask your lawyer to apply to the court for an order to prevent him from hindering the valuator from doing his job.
