Suing for slander |

A woman who has been married for 10 years is planning to divorce her husband because she found out recently that he is involved in a relationship with one of her friends. But, according to the woman, she did not take the issue lightly because "when I heard about the love affair, I confronted my husband about it and we had a fight". She said he admitted he was having an affair with her friend and begged her to forgive him because he still loved her. "How can my husband love me and then become involve with another woman, especially my friend? she queried. "I have never cheated on my husband, because I love him and I take my marriage vow seriously," she said. "I moved out of the house after my husband admitted that he was in a relationship with my so-called friend. Last month, I saw him on the street and he began crying. He said he was still in love with me and asked me to come back home. "Some of my friends encouraged me to go back to my husband, because he is a good provider. I went back to live with my husband, but exactly one day after I returned home, my friend turned up at the gate. "She told me all sort of things that my husband said about me. The things she said are true, and she could not have known about them if my husband did not tell her. She actually told me to leave my husband, because he was the one paying her rent. "When I called my husband at work and told him that the woman was at my gate, he began crying over the telephone, saying I should not leave him again. I did not leave the house, because I wanted to show the woman that I was not moving out because of what she said. If I leave now, it would seem that I am leaving because she told me to leave my husband. "I am still planning to divorce him, but I am saving some money that I can pay him for his half share of the house when I divorce him. He has stopped paying the woman's rent and, when he gets his pay, he takes it to me for me to handle it. He says he is giving me his pay just for me to prove that he is no longer involved with the woman. "Last week, the woman sent one of her friends to serve me with a summons for slander. She is accusing me of calling her certain names when she came to my gate. Yes, I agree I did call her names, because I think she was very out of order to come to my gate, telling me to leave my husband, but I did not know I could be sued," she said. Slander is making a false statement that damages a person's reputation about a person. However, the person against whom the false statement is made can only sue for slander if other persons were present when the false statement was made. |
