Court orders suspect's release

A suspect in the murder of a police was ordered released by the court yesterday following a habeas corpus application yesterday.

Richardo Spencer, who was being held for the death of 27-year-old Special Constable Dwayne Peart of Harman Barracks, was freed following a habeas corpus application by his lawyer Dwight Reece.

A writ of habeas corpus is a legal action which requires a person under arrest to be brought before a judge or into court or released lacking sufficient cause or evidence.

The attorney told the court that he accompanied his client to the police after he was listed as a person of interest. Reece told Resident Magistrate (RM) Marcia Dunbar-Green that an identification parade was held and he was not pointed out.

The RM then ordered that Spencer be released immediately. Spencer was taken into custody because of the death of theJanuary 29 death of the special constable along Grange Lane in St Catherine. Peart was driving along the road when he came upon a group of men dressed as police personnel. He stopped to assist them when members of the group shot him. He ran a short distance but was chased and shot again.

He was taken to the Spanish Town Hospital where he was pronounced dead.
